| BCCI – MSM Deal Falls Through |

While until yesterday the cricket news had it that a resolution was being reached by the BCCI (Board for Cricket Control in India) and MSM (Multi Screen Media), today it has been confirmed that the talks have fallen through. It was expected that an out of court settlement may be reached, however this is now not possible because according to Lalit Modi, IPL chairman, MSM wanted a non terminable contract.
It would seem that IPL Season 2 will have a different broadcaster this year from the one last year. This is because the settlement negotiations that were ongoing have fallen though. According to IPL chairman, Lalit Modi, MSM which holds the IPL contract wanted a non terminable contract and that is the reason that the talks ended without reaching a resolution. "We had agreed on various commercial terms but if we agree to a non-terminable contract we cannot terminate the arrangement even in case of a serious breach," Modi said. “Even if there’s a serious breach, we cannot terminate the contract in future. How can that be acceptable to anybody?” Modi added. Last weekend MSM sought an injunction against BCCI to for the Bombay High Court last weekend, seeking to stay the BCCI’s attempt to negotiate a fresh contract for IPL’s broadcast rights. Thereafter BCCI had stipulated that the matter should be withdrawn from court, pursuant to which BCCI would be willing to renegotiate the deal with MSM. BCCI now claims that the WSG deal remains in force in view of these negotiations falling through though it had been stayed by the court following the MSM suit. It was the falling though of the deal between Big TV and Sony last month that caused financial losses to IPL which soured relations between IPL and Sony. What also rocked the boat was the resignation of Kunal Dasgupta from the top spot in Sony. Dasgupta was known to be close to Modi. With the rescheduling of the IPL and new venues being added to the itinerary, Sony also is looking to renegotiate the financial terms of its contract with the IPL.
