Lalit Modi Appoints Panel Print E-mail

Lalit Modi seems to found out the way out of entangles which have engulfed Rajasthan Cricket Association. He has appointed a three-member arbitration tribunal to look into the contentions raised by some district associations against him and decide if he is fit to continue in the high profile post.

Cricket360 wonders, whether the ideological posture that Lalit Modi has acquired has got something to do with the advertisement campaign in which he features, as he conveys the image of one who has attained his position with dogged perseverance and honesty.

It can be seen from the construct of the panel appointed by Modi which has legal luminaries of India and includes retires Supreme court Chief Justice R C Lahoti, retired Supreme court Justice Kuldeep SIngh and Justice A R Lakshamanan. Modi informed that the action, which he has taken, is in conformity with the Article 43 of the byelaws of the RCA, which makes it a duty of the president to refer to any dispute relating to constitution, management and election of the Association to Arbitration.

The appointment of such legal luminaries has been to sniff any controversy in the bud that may be associated with him of having used the powers of his office to appoint persons who could give judgment in his favour. Cricket360.com feels by being able to do so, Modi has sort of added more to his persona, and this could have positive fallouts in cricket association issues elsewhere as well.  The terms of references for the panel mainly are to arbitrate on the validity of the amended constitution, the RCA election and allegations of financial irregularity, among other issues.

In an associated development with this issue Supreme Court has fixed February 23 as the date to hear the plea of faction ridden RCS which has sought the direction of the court for holding elections for its executive committee, whose terms comes to an end on February, 21.

Lalit Modi had filed an application in this regard before the Supreme Court and it has been mentioned before a bench, which is headed by the Chief Justice of India, KG Balakrishnan. Chief Justice has taken a view that there is nothing urgent in the matter and that it can be decided in its normal course. Lalit Modi is being represented by senior advocate Abhishek Singhvi and Ankur Chawla, who have said that there was a need for appropriate directions from the Apex Court, to facilitate conduct of elections in a proper manner. The direction has arisen on account of the petition in the matter pending before the Supreme Court.
